The payment of the remuneration referred to in Article 9b, paragraph 1, shall be made to a legal person to be designated by Our Minister of Justice and Security, in agreement with Our Minister of Education, Culture and Science. This legal person is exclusively charged with the collection and distribution of the remuneration.
The person who is obliged to pay the compensation referred to in Article 9b, paragraph 1, shall, upon the request of the person entitled to such compensation, provide all information necessary for obtaining payment.
The person who is obligated to pay the remuneration referred to in Article 9b, paragraph 1, shall, insofar as no other time has been agreed upon, provide the legal entity referred to in the first paragraph with a statement of the income derived from the phonogram before 1 April of each calendar year. Furthermore, upon request, he is obliged to immediately make available for inspection to this legal entity the documents or other information carriers, the examination of which is necessary for the determination of the liability for and the amount of the remuneration.
Any person who intentionally fails to provide the statement referred to in the previous paragraph, or who intentionally makes an incorrect or incomplete statement in such a statement, shall be punished by detention for a term not exceeding three months or a fine of the third category. The act shall be considered a summary offence (overtreding).
De betaling van de in artikel 9b, eerste lid bedoelde vergoeding geschiedt aan een door Onze Minister van Justitie en Veiligheid, in overeenstemming met Onze Minister van Onderwijs, Cultuur en Wetenschap aan te wijzen rechtspersoon. Deze rechtspersoon is met uitsluiting van anderen belast met de inning en verdeling van de vergoeding.
Degene die is verplicht tot betaling van de in artikel 9b, eerste lid bedoelde vergoeding verschaft de gerechtigde tot die vergoeding op zijn verzoek alle informatie die noodzakelijk is ter verkrijging van de betaling.
Degene die is verplicht tot betaling van de in artikel 9b, eerste lid bedoelde vergoeding, doet, voor zover geen ander tijdstip is overeengekomen, vóór 1 april van ieder kalenderjaar aan de in het eerste lid bedoelde rechtspersoon opgave van de inkomsten die hij met het fonogram heeft verkregen. Hij is voorts gehouden desgevraagd aan deze rechtspersoon onverwijld de bescheiden of andere informatiedragers ter inzage te geven, waarvan kennisneming noodzakelijk is voor de vaststelling van de verschuldigdheid en de hoogte van de vergoeding.
Degene die de in het vorige lid bedoelde opgave opzettelijk nalaat dan wel in die opgave opzettelijk een onjuiste of onvolledige mededeling doet, wordt gestraft met hechtenis van ten hoogste drie maanden of geldboete van de derde categorie. Het feit wordt beschouwd als een overtreding.
