If provided for by public law regulation or collective labour agreement, the employer may satisfy his obligations towards the employee regarding the holiday allowance either by transferring holiday vouchers to the employee at the expense of a fund, or by payment of the holiday allowance to a fund at the expense of which the employee acquires the right to holiday allowance, provided that the amount to which the employee acquires a right against that fund by such transfer or such payment, respectively, is not lower than the amount to which the employee is entitled pursuant to Articles 15 and 16.
A fund as referred to in paragraph 1 must be organised in accordance with the conditions set pursuant to Article 631, paragraph 3, under (c), of Book 7 of the Civil Code.
Indien hierin bij publiekrechtelijke regeling of collectieve arbeidsovereenkomst is voorzien, kan de werkgever aan zijn verplichtingen tegenover de werknemer betreffende de vakantiebijslag voldoen hetzij door aan de werknemer vakantiebonnen over te dragen ten laste van een fonds, hetzij door betaling van de vakantiebijslag aan een fonds ten laste waarvan de werknemer het recht op vakantiebijslag verwerft, mits het bedrag, waarop de werknemer door deze overdracht onderscheidenlijk deze betaling, op dat fonds recht verwerft, niet lager ligt dan het bedrag, waarop de werknemer krachtens de artikelen 15 en 16 recht heeft.
Een fonds als bedoeld in het eerste lid dient te zijn ingericht overeenkomstig de voorwaarden, gesteld krachtens artikel 631, derde lid, onder c, van Boek 7 van het Burgerlijk Wetboek.
