With regard to employees working in the Netherlands who are members of a special negotiating body or of a European Works Council, or who act as representatives in any other form of information and consultation of employees, the second to seventh paragraphs inclusive shall apply.

These employees shall retain their entitlement to wages for the time during which they have not performed the stipulated work as a result of attending a meeting of the special negotiating body or of the European Works Council, or a meeting within the framework of another method of information and consultation.

To the extent that it is reasonably necessary for the performance of their duties, they shall be granted the opportunity during working hours and with retention of wages for mutual consultation and deliberation with other persons regarding matters in which they are involved in the exercise of their function, and to receive training and education. Facilities shall be made available to them which they reasonably require in the exercise of their duties.

They are obliged to maintain the confidentiality of all trade and business secrets of which they become aware in their capacity, as well as of all matters regarding which confidentiality has been imposed upon them or of which they, in connection with imposed confidentiality, must understand the confidential nature. This obligation also applies to persons who perform a function as referred to in the first paragraph without being an employee.

The obligation of confidentiality does not apply with respect to a person who is approached for consultation or as an expert as referred to in Articles 12 and 20, provided that the executive board or the person who imposed the confidentiality has given prior consent for this and the person concerned has declared in writing that they commit themselves to confidentiality regarding the matter in question. In that case, the duty of confidentiality applies to the aforementioned person.

The duty of confidentiality shall not lapse upon the termination of the position referred to in the first paragraph, nor upon the termination of the activities of the person concerned within the enterprise.

The employer shall ensure that those who are or have been candidates for a position as referred to in the first paragraph, as well as those who hold or have held such a position, are not prejudiced in their position within the undertaking by reason thereof.

Without prejudice to any obligation of confidentiality incumbent upon them, employees who are members of a European Works Council or who act as representatives in another procedure for the information and consultation of employees shall inform the employee representatives within the Community-scale undertaking or group, or, in the absence of such representatives, all employees, regarding the content and the results of the information and consultation procedure that has taken place in accordance with this Act.

Any employee or employee representative working in the Netherlands may request the employer to provide the information necessary for the commencement of negotiations as referred to in Article 8, paragraph 1. This information shall in any event include an overview of the number of employees working at the Community-scale undertaking or group and the distribution of these employees across the various Member States concerned.

10.

The employer of an employee working in the Netherlands who has been appointed or elected as a member of a special negotiating body or of a European Works Council shall notify the central management of such election or appointment.

Ten aanzien van de in Nederland werkzame werknemers die lid zijn van een bijzondere onderhandelingsgroep of van een Europese ondernemingsraad dan wel optreden als vertegenwoordigers bij een andere wijze van informatieverstrekking en raadpleging van werknemers, gelden het tweede tot en met het zevende lid.

Deze werknemers behouden hun aanspraak op loon voor de tijd gedurende welke zij niet de bedongen arbeid hebben verricht ten gevolge van het bijwonen van een vergadering van de bijzondere onderhandelingsgroep of van de Europese ondernemingsraad, dan wel van een vergadering in het kader van de andere wijze van informatieverstrekking en raadpleging.

Voor zover dat redelijkerwijs noodzakelijk is voor de vervulling van hun taak, wordt hun in werktijd en met behoud van loon de gelegenheid geboden tot onderling beraad en overleg met andere personen over aangelegenheden waarbij zij in de uitoefening van hun functie zijn betrokken en om scholing en vorming te ontvangen. Aan hen worden voorzieningen ter beschikking gesteld, die zij in de uitoefening van hun taak redelijkerwijs nodig hebben.

Zij zijn verplicht tot geheimhouding van alle zaken- en bedrijfsgeheimen die zij in hun hoedanigheid vernemen, alsmede van alle aangelegenheden ten aanzien waarvan hun geheimhouding is opgelegd of waarvan zij, in verband met opgelegde geheimhouding, het vertrouwelijke karakter moeten begrijpen. Deze verplichting geldt ook voor personen die een functie als bedoeld in het eerste lid vervullen zonder werknemer te zijn.

De verplichting tot geheimhouding geldt niet tegenover hem die wordt benaderd voor overleg of als deskundige als bedoeld in de artikelen 12 en 20, mits het hoofdbestuur of degene die de geheimhouding heeft opgelegd, vooraf daarvoor toestemming heeft gegeven en de betrokken persoon schriftelijk heeft verklaard dat hij zich ten aanzien van de betrokken aangelegenheid tot geheimhouding verplicht. In dat geval is ten aanzien van de bedoelde persoon de geheimhoudingsplicht van toepassing.

De plicht tot geheimhouding vervalt niet door beëindiging van de in het eerste lid bedoelde functie, noch door beëindiging van de werkzaamheden van de betrokkene in de onderneming.

De werkgever draagt er zorg voor, dat degenen die kandidaat staan of gestaan hebben voor een functie als bedoeld in het eerste lid, alsmede degenen die deze functie vervullen of hebben vervuld, niet uit hoofde hiervan worden benadeeld in hun positie in de onderneming.

Onverminderd enige op hen rustende verplichting tot geheimhouding informeren de werknemers, die lid zijn van een Europese ondernemingsraad dan wel optreden als vertegenwoordigers bij een andere procedure van informatieverstrekking en raadpleging van werknemers, de werknemersvertegenwoordigers binnen de communautaire onderneming of groep, of, als die er niet zijn, alle werknemers over de inhoud en de resultaten van de informatie- en raadplegingsprocedure die overeenkomstig deze wet heeft plaatsgevonden.

Iedere in Nederland werkzame werknemer of werknemersvertegenwoordiger kan van de werkgever verlangen dat deze hem gegevens verstrekt die benodigd zijn voor de opening van onderhandelingen als bedoeld in artikel 8, eerste lid. Deze gegevens bevatten in ieder geval een overzicht van het aantal werknemers dat bij de communautaire onderneming of groep werkzaam is en de verdeling van deze werknemers over de verschillende betrokken staten.

10.

De werkgever van een in Nederland werkzame werknemer die is aangewezen of gekozen als lid van een bijzondere onderhandelingsgroep of van een Europese ondernemingsraad doet van die verkiezing of aanwijzing mededeling aan het hoofdbestuur.
