Article 18
in forceBy or pursuant to an Order in Council, rules shall be laid down concerning:
the data that Our Minister provides to the COA with a view to drawing up the budget, as well as the time by which these data are provided at the latest;
the time limit within which Our Minister decides on the application for the granting, respectively for the determination, of the subsidy;
the manner in which the subsidy is determined;
the cases in which the COA owes compensation for capital formation as referred to in Article 4:41 of the General Administrative Law Act, as well as how this compensation is calculated;
the size and supplementation of the equalisation reserve and the application of surpluses;
the other obligations attached to the subsidy;
The granting of advances.
The recommendation for an order in council established pursuant to the first paragraph shall not be made until after the draft has been submitted to both Houses of the States General.
Bij of krachtens algemene maatregel van bestuur worden regels gesteld omtrent:
de gegevens die Onze Minister met het oog op het opstellen van de begroting verstrekt aan het COA, alsmede op welk tijdstip deze gegevens uiterlijk worden verstrekt;
de termijn waarbinnen Onze Minister op het verzoek tot verlening onderscheidenlijk tot vaststelling van de subsidie beslist;
de wijze waarop de subsidie wordt bepaald;
de gevallen waarin het COA een vergoeding voor vermogensvorming als bedoeld in artikel 4:41 van de Algemene wet bestuursrecht verschuldigd is, alsmede hoe deze vergoeding wordt berekend;
de omvang en aanvulling van de egalisatiereserve en de aanwending van overschotten;
de overige aan de subsidie verbonden verplichtingen;
het verlenen van voorschotten.
De voordracht voor een krachtens het eerste lid vastgestelde algemene maatregel van bestuur wordt niet gedaan dan nadat het ontwerp aan de beide kamers der Staten-Generaal is overgelegd.
