By or pursuant to an Order in Council (algemene maatregel van bestuur), rules shall be established for the implementation of the Procedure Regulation and the Asylum and Migration Management Regulation regarding:
the manner of submission and processing of an application;
the procedure for the processing of an application for the granting of an asylum residence permit as referred to in Article 28, if this is necessary for the implementation of the Procedures Regulation or the Asylum and Migration Management Regulation;
the manner in which decisions issued by or pursuant to this Act with respect to the foreign national, as well as the notifications, communications or messages prescribed by or pursuant to this Act to the foreign national or to other interested parties, are to be made known. In this regard, it may be stipulated that the making known of decisions may also take place by means of the sending or handing over of a document and by the making of annotations in a document to be designated for that purpose.
Bij of krachtens algemene maatregel van bestuur worden ter uitvoering van de Procedureverordening en de Asiel- en migratiebeheerverordening regels gesteld omtrent:
de wijze van indiening en behandeling van een aanvraag;
de procedure voor de behandeling van een aanvraag tot het verlenen van een verblijfsvergunning asiel als bedoeld in artikel 28, indien dat noodzakelijk is ter uitvoering van de Procedureverordening of de Asiel- en migratiebeheerverordening;
de wijze waarop beschikkingen bij of krachtens deze wet ten aanzien van de vreemdeling gegeven, alsmede de bij of krachtens deze wet voorgeschreven kennisgevingen, mededelingen of berichten aan de vreemdeling of aan andere belanghebbenden worden bekendgemaakt. Daarbij kan worden bepaald, dat de bekendmaking van beschikkingen ook kan geschieden door middel van het toezenden of uitreiken van een document en door het stellen van aantekeningen in een daarbij aan te wijzen document.

The person concerned has lodged an appeal against the failure to take a timely decision on an application to grant him a fixed-term asylum residence permit. This ruling concerns the interpretation and application of Article 42, paragraph 1, of the Vw 2000. It states that the Minister must take a decision within six months after receipt of an asylum application. The parties differ in opinion regarding the moment at which the asylum application was received according to that provision and, consequently, when the decision-making period commences. The person concerned asserts that the moment at which he reported in person to the authorities must be taken as the starting point. Therefore, according to the person concerned, the date of the so-called "loopbrief" must be used. This is a letter that a foreign national receives from the Minister at the moment that the foreign national first reports to an application centre of the IND. The Minister, on the other hand, asserts that the moment at which a foreign national has formally submitted his asylum application using the form model M35-H must be taken as the starting point. This ruling, therefore, concerns the question of when the decision-making period commences. The answer to that question is relevant for the assessment of whether, and at what moment, the Minister exceeded that period. In cases such as this, which concern an appeal against the failure to take a timely decision, the administrative court must assess this.
