The application for the grant of a residence permit for asylum as referred to in Article 28 shall, in derogation from Article 2:1, second paragraph, of the General Administrative Law Act (Algemene wet bestuursrecht), be submitted by the foreign national or his legal representative.
In accordance with Article 19 of the Procedure Regulation and Article 21 of the Asylum and Migration Management Regulation, rules shall be established by regulation of Our Minister regarding:
the recognition or admission of legal advisers or other counselors who provide free legal counseling to, assist, or represent the foreign national during the processing of the application for an asylum residence permit as referred to in Article 28;
the accreditation of non-governmental organisations providing legal services or representation to this foreign national; and
the procedural rules for the submission and processing of petitions for legal counseling free of charge and legal representation, including rules regarding the exclusion or limitation thereof.
De aanvraag tot het verlenen van een verblijfsvergunning asiel als bedoeld in artikel 28 wordt, in afwijking van artikel 2:1, tweede lid, van de Algemene wet bestuursrecht, ingediend door de vreemdeling of zijn wettelijk vertegenwoordiger.
Overeenkomstig artikel 19 van de Procedureverordening en artikel 21 van de Asiel- en migratiebeheerverordening worden bij regeling van Onze Minister regels gesteld over:
de erkenning of toelating van juridisch adviseurs of andere counselors die de vreemdeling tijdens de behandeling van de aanvraag om een verblijfsvergunning asiel als bedoeld in artikel 28 kosteloze juridische counseling verstrekken, bijstaan of vertegenwoordigen;
de accreditatie van niet-gouvernementele organisaties die deze vreemdeling juridische diensten of vertegenwoordiging bieden; en
de procedurele regels voor de indiening en behandeling van verzoeken om kosteloze juridische counseling en wettelijke vertegenwoordiging, waaronder regels over het uitsluiten of beperken daarvan.
