Following the day on which he has made the declaration referred to in Article 41, the fugitive may remain in custody or in police detention for a maximum of twenty days only.

The preceding paragraph shall not apply if the public prosecutor has decided that no effect shall be given to the declaration and the petition for extradition, together with the accompanying documents, has been submitted to the court in accordance with Article 23, paragraph 1.

The time limit stipulated in the first paragraph of this article may be extended by the court upon the application of the Public Prosecution Service. Article 38, paragraphs one and two, shall apply mutatis mutandis.

Extension may only occur when, due to special circumstances, the surrender could not take place within the period of twenty days.

Na de dag waarop hij de in artikel 41 bedoelde verklaring heeft afgelegd, kan de voortvluchtige nog slechts gedurende ten hoogste twintig dagen in bewaring of in verzekering gesteld blijven.

Het vorige lid blijft buiten toepassing, indien de officier van justitie heeft beslist dat aan de verklaring geen gevolg zal worden gegeven en het verzoek tot uitlevering, met de daarbij behorende stukken, overeenkomstig artikel 23, eerste lid, aan de rechtbank is overgelegd.

De in het eerste lid van dit artikel gestelde termijn kan, op vordering van de officier van justitie, door de rechtbank worden verlengd. Artikel 38, eerste en tweede lid, is van overeenkomstige toepassing.

Verlenging kan alleen geschieden wanneer de uitlevering door bijzondere omstandigheden niet binnen de termijn van twintig dagen heeft kunnen plaats hebben.
