If the public prosecutor has decided, in accordance with Article 42, that the fugitive shall be placed at the disposal of the authorities of the other state, Article 23 shall not apply.
If the claim referred to in Article 23 has already been submitted to the court, it shall be withdrawn without delay. The clerk of the court shall thereupon return the petition for extradition, together with the accompanying documents, to the public prosecutor.
The public prosecutor shall notify the claimed person of the withdrawal of the claim.
Indien de officier van justitie overeenkomstig artikel 42 heeft beslist, dat de voortvluchtige ter beschikking zal worden gesteld van de autoriteiten van de andere staat, blijft artikel 23 buiten toepassing.
Is de in artikel 23 bedoelde vordering reeds bij de rechtbank ingediend, dan wordt deze onverwijld ingetrokken. De griffier van de rechtbank stelt alsdan het verzoek tot uitlevering, met de daarbij behorende stukken, weder in handen van de officier van justitie.
Van het intrekken van de vordering geeft de officier van justitie kennis aan de opgeëiste persoon.
