A fugitive whose detention has been ordered in accordance with Article 15 shall be released — without prejudice to the possibility of further deprivation of liberty on other grounds —:

a.

as soon as this is ordered by the court, the examining magistrate or the public prosecutor, either of their own motion or upon the petition of the fugitive or their counsel;

b.

as soon as the period has expired within which, in accordance with the applicable treaty, the provisional arrest must be followed by a request for extradition, and such a request has not been made in the meantime;

c.

as soon as the custody has lasted for twenty days.

In cases where Article 13, paragraph 3, applies, the periods referred to in the previous paragraph, under (b) and (c), upon the expiry of which the fugitive must be released, shall be extended by four days.

Een voortvluchtige wiens bewaring overeenkomstig artikel 15 is bevolen, wordt - behoudens de mogelijkheid van verdere vrijheidsbeneming uit anderen hoofde - in vrijheid gesteld:

a.

zodra zulks door de rechtbank, de rechter-commissaris of de officier van justitie, ambtshalve of op verzoek van de voortvluchtige of diens raadsman, wordt gelast;

b.

zodra de termijn is verstreken binnen welke, volgens het toepasselijke verdrag, de voorlopige aanhouding moet worden gevolgd door een verzoek tot uitlevering, en zodanig verzoek niet inmiddels is gedaan;

c.

zodra de bewaring twintig dagen heeft geduurd.

In gevallen waarin artikel 13, derde lid, toepassing vindt, worden de in het vorige lid, onder b en c, genoemde tijdvakken, na afloop waarvan de voortvluchtige in vrijheid moet worden gesteld, met vier dagen verlengd.
