The COA shall ensure that, during the stay in the reception facility, account is taken of the specific situation of persons with special reception needs as referred to in Article 24 of the Reception Conditions Directive, as well as foreign nationals who have received a transfer decision as referred to in Article 44a of the Aliens Act 2000.
In implementation of paragraph 1, the COA shall assess, as soon as possible after the submission of the asylum application, whether the asylum seeker has special reception needs. The outcome shall be recorded in his file, including a description of the visible signs or the statements or conduct that are relevant to the assessment of the special reception needs, as well as the measures that have been determined to meet those needs.
If the asylum seeker, in accordance with paragraph 2, has special reception needs, specific support and guidance shall be provided in addition to the provisions referred to in Article 9, paragraph 1, or Article 9a.
The assessment referred to in paragraph 2 shall be completed within 30 days after the submission of the asylum application.
If there are indications that the mental or physical health may affect the reception needs, the asylum seeker shall be referred to an appropriate physician or psychologist for a further assessment of his psychological and physical condition. If necessary, an oral translation shall be provided.
Het COA zorgt ervoor dat tijdens het verblijf in de opvangvoorziening rekening wordt gehouden met de specifieke situatie van personen met bijzondere opvangbehoeften als bedoeld in artikel 24, alsmede vreemdelingen die een die een overdrachtsbesluit als bedoeld in artikel 44a van de Vreemdelingenwet 2000 hebben ontvangen van de Opvangrichtlijn.
Ter uitvoering van het eerste lid beoordeelt het COA zo spoedig mogelijk na indiening van de asielaanvraag of de asielzoeker bijzondere opvangbehoeften heeft. De uitkomst wordt opgenomen in zijn dossier, met vermelding van een beschrijving van de zichtbare tekenen of de verklaringen of gedragingen die relevant zijn voor de beoordeling van de bijzondere opvangbehoeften, alsmede de maatregelen die zijn vastgesteld om in die behoeften te voorzien.
Indien de asielzoeker overeenkomstig het tweede lid bijzondere opvangbehoeften heeft, wordt naast de verstrekkingen, bedoeld in artikel 9, eerste lid, of artikel 9a specifieke steun en begeleiding geboden.
De in het tweede lid bedoelde beoordeling wordt afgerond binnen 30 dagen na indiening van de asielaanvraag.
Indien er aanwijzingen zijn dat de mentale of fysieke gezondheid van invloed kan zijn op de opvangbehoeften wordt de asielzoeker ter nadere beoordeling van zijn psychologische en fysieke toestand doorverwezen naar een geschikte arts of psycholoog. Indien nodig wordt een mondelinge vertaling verzorgd.
