The delivery, required for the transfer of the patent or the right resulting from a patent application, shall be effected by means of a deed containing the declaration of the entitled party that he transfers the patent or the right resulting from the patent application to the acquirer, and of the latter that he accepts this transfer.
Any reservation concerning the transfer must be described in the deed; in the absence thereof, the transfer shall be deemed to be unlimited.
The transfer shall only be effective against third parties once the deed has been entered in the patent register. Both parties are equally authorised to effect this entry.
Article 88 of Book 3 of the Dutch Civil Code shall apply.
De levering, vereist voor de overdracht van het octrooi of het recht, voortvloeiende uit een octrooiaanvrage, geschiedt bij een akte, houdende de verklaring van de rechthebbende, dat hij het octrooi of het recht, voortvloeiende uit de octrooiaanvrage, aan de verkrijger overdraagt, en van deze, dat hij deze overdracht aanneemt.
Elk voorbehoud, de overdracht betreffende, moet in de akte omschreven zijn; bij gebreke daarvan geldt de overdracht voor onbeperkt.
De overdracht werkt tegenover derden eerst wanneer de akte in het octrooiregister is ingeschreven. Tot het doen verrichten van deze inschrijving zijn beide partijen gelijkelijk bevoegd.
Artikel 88 van Boek 3 van het Nederlandse Burgerlijk Wetboek is van toepassing.
