If the patent belongs to several persons jointly, their mutual relationship shall be governed by what has been determined between them by agreement.
If there is no agreement or if it has not been provided otherwise in the agreement, every entitled party has the authority to perform the acts mentioned in Article 53 and to take action pursuant to Articles 70 up to and including 73 against such acts as well as acts as referred to in Article 54, paragraph 1, which have been performed without authority, but a licence or consent may only be granted by the entitled parties by mutual agreement.
The entitled parties are jointly and severally liable for the payment of the amounts referred to in Article 61.
Indien het octrooi aan verscheidene personen gezamenlijk toekomt, wordt hun onderlinge verhouding beheerst door hetgeen tussen hen bij overeenkomst is bepaald.
Indien er geen overeenkomst is of indien in de overeenkomst niet anders is bepaald, heeft iedere rechthebbende de bevoegdheid de in artikel 53 genoemde handelingen te verrichten en tegen zulke handelingen alsmede handelingen als bedoeld in artikel 54, eerste lid, die onbevoegdelijk zijn verricht, ingevolge de artikelen 70 tot en met 73 op te treden, doch kan een licentie of toestemming door de rechthebbenden slechts met gemeen goedvinden verleend worden.
Voor de betaling van de in artikel 61 genoemde bedragen zijn de rechthebbenden hoofdelijk verbonden.
