A patent attorney who has been declared bankrupt, in respect of whom the natural persons debt restructuring scheme has been declared applicable, or who has been placed under guardianship (curatele), is by operation of law suspended during the bankruptcy, the application of the natural persons debt restructuring scheme, or the guardianship from exercising the right to act as an attorney before the Office or to address the court during the hearing of disputes. During this period, he is also by operation of law suspended as a member of the Order.
In the event that a patent attorney is unable to represent the interests entrusted to him in that capacity, or in the event that he has deceased, the chairman of the supervisory board shall, if a replacement has not already been provided for, appoint a patent attorney who shall, for as long as the chairman deems necessary, take the measures that are required under the given circumstances.
Een octrooigemachtigde die in staat van faillissement is verklaard, ten aanzien van wie de schuldsaneringsregeling natuurlijke personen van toepassing is verklaard, of die onder curatele is gesteld, is gedurende het faillissement, de toepassing van de schuldsaneringsregeling natuurlijke personen of de curatele van rechtswege geschorst in de uitoefening van het recht als gemachtigde voor het bureau op te treden of bij de behandeling ter terechtzitting van geschillen het woord te voeren. Gedurende deze tijd is hij tevens van rechtswege geschorst als lid van de orde.
Ingeval een octrooigemachtigde niet in staat is de belangen te behartigen die hem in die hoedanigheid zijn toevertrouwd, dan wel ingeval hij overleden is, wijst de voorzitter van de raad van de toezicht, indien niet reeds in de vervanging is voorzien, een octrooigemachtigde aan, die, zolang de voorzitter dit nodig oordeelt, de maatregelen neemt die onder de gegeven omstandigheden geboden zijn.
