in forceCONDITIONAL TERMINATION OF THE ORDER FOR COMPULSORY TREATMENT AND OF THE PLACEMENT UNDER A HOSPITAL ORDER WITH CONDITIONS
The probation service may submit a proposal to the public prosecution service for the amendment, supplementation or lifting of the conditions referred to in Article 38, paragraph 1, and Article 38g, paragraph 2, of the Criminal Code. The proposal shall be sent through the intermediary of Our Minister to the public prosecution service at the court that heard the criminal offence in the first instance for which the placement under a hospital order (terbeschikkingstelling) was ordered.
De reclassering kan een voorstel doen aan het openbaar ministerie tot wijziging, aanvulling of opheffing van de voorwaarden, bedoeld in artikel 38, eerste lid, en artikel 38g, tweede lid, van het Wetboek van Strafrecht. Het voorstel wordt door tussenkomst van Onze Minister aan het openbaar ministerie bij de rechtbank die in eerste aanleg heeft kennis genomen van het misdrijf ter zake waarvan de terbeschikkingstelling is gelast, gezonden.
