Article 71
in forceCONDITIONAL TERMINATION OF THE ORDER FOR COMPULSORY TREATMENT AND OF THE PLACEMENT UNDER A HOSPITAL ORDER WITH CONDITIONS
If the person placed under a hospital order (terbeschikkinggestelde) violates the conditions, or if the interest of the safety of others or the general safety of persons or property otherwise requires it, the probation service (reclassering) may, through the intervention of Our Minister, submit a proposal to issue an order for nursing (verpleging) to the public prosecution service at the court that, in the first instance, took cognizance of the criminal offence for which the placement under a hospital order (terbeschikkingstelling) was ordered.
Upon request, the probation service shall provide advice to Our Minister and the Public Prosecution Service referred to in the first paragraph.
Indien de ter beschikking gestelde de voorwaarden overtreedt, of anderzins het belang van de veiligheid van anderen dan wel de algemene veiligheid van personen of goederen zulks eist, kan de reclassering een voorstel tot het geven van een bevel tot verpleging door tussenkomst van Onze Minister zenden aan het openbaar ministerie bij de rechtbank die in eerste aanleg heeft kennis genomen van het misdrijf ter zake waarvan de terbeschikkingstelling is gelast.
De reclassering dient desgevraagd Onze Minister en het openbaar ministerie, bedoeld in het eerste lid, van advies.
