The Public Prosecution Service in the district where the person placed at the disposal of the government (ter beschikking gestelde) actually resides is also charged with the supervision of compliance with the conditions referred to in Article 38, paragraph 1, and the conditions referred to in Article 38g, paragraph 2, of the Criminal Code.
The Public Prosecution Service, as referred to in the first paragraph, shall, insofar as necessary, be informed by Our Minister of the conditions referred to in the first paragraph and of any mandate granted for the provision of assistance and support. A judicial decision issued at a later date regarding conditions, a mandate for the provision of assistance and support, or the extension of the placement at the disposal of the government (terbeschikkingstelling) shall likewise, insofar as necessary, be brought to the attention of this Public Prosecution Service. The Public Prosecution Service shall, if necessary, cause the new or amended conditions to be endorsed on the discharge letter.
Met het toezicht op de naleving van de voorwaarden, bedoeld in artikel 38, eerste lid, en van de voorwaarden, bedoeld in artikel 38g, tweede lid, van het Wetboek van Strafrecht, is steeds mede belast het openbaar ministerie in het arrondissement waarin de ter beschikking gestelde feitelijk woont.
Het openbaar ministerie, bedoeld in het eerste lid, wordt, voor zover nodig, door Onze Minister in kennis gesteld van de voorwaarden, bedoeld in het eerste lid, en van een verstrekte opdracht tot het verlenen van hulp en steun. Een op een later tijdstip gegeven rechterlijke beslissing met betrekking tot voorwaarden, opdracht tot het verlenen van hulp en steun of verlenging van de terbeschikkingstelling wordt eveneens, voor zover nodig, ter kennis van dit openbaar ministerie gebracht. Het openbaar ministerie doet zo nodig de nieuwe of gewijzigde voorwaarden op de ontslagbrief aantekenen.
