in forceEXTENSION OF THE PLACEMENT UNDER A HOSPITAL ORDER (TERBESCHIKKINGSTELLING)
If the nursing has been terminated conditionally or if conditions have been attached to the placement at the disposal of the government (terbeschikkingstelling), the probation service providing assistance and support to the person placed at the disposal of the government shall, if extension of the placement at the disposal of the government is legally possible, send an opinion regarding the desirability of such extension to Our Minister three months before the date on which the term of the placement at the disposal of the government will have expired. This opinion shall be accompanied by a reasoned, dated, and signed opinion from a psychiatrist or a psychologist who has personally examined the person placed at the disposal of the government.
The documents referred to in the first paragraph shall be sent, through the intermediary of Our Minister, to the public prosecution service referred to in Article 46, paragraph 5, two months before the time at which the period of the placement at the disposal of the government (terbeschikkingstelling) will have expired.
Indien de verpleging voorwaardelijk is beëindigd of aan de terbeschikkingstelling voorwaarden zijn verbonden, zendt de reclassering die de ter beschikking gestelde hulp en steun verleent, indien verlenging van de terbeschikkingstelling wettelijk mogelijk is, drie maanden voor het tijdstip waarop de termijn van de terbeschikkingstelling zal zijn verstreken, advies inzake de wenselijkheid van die verlenging aan Onze Minister. Dit advies gaat vergezeld van een met redenen omkleed, gedagtekend en ondertekend advies van een psychiater of een psycholoog die zelf de ter beschikking gestelde heeft onderzocht.
De in het eerste lid bedoelde stukken worden twee maanden voor het tijdstip waarop de termijn van de terbeschikkingstelling zal zijn verstreken door tussenkomst van Onze Minister toegezonden aan het openbaar ministerie, bedoeld in artikel 46, vijfde lid.
