in forceEXTENSION OF THE PLACEMENT UNDER A HOSPITAL ORDER (TERBESCHIKKINGSTELLING)
If the Public Prosecution Service, pursuant to the preliminary advice referred to in Article 47, intends to submit a claim for the extension of the placement under a hospital order (terbeschikkingstelling) whereby the total duration of the placement under a hospital order exceeds a period of four years or a multiple of four years, it shall notify Our Minister thereof as soon as possible.
Upon receipt of the notification referred to in the first paragraph, Our Minister shall ensure the timely preparation of an opinion or expert report as referred to in Article 509o, fourth paragraph, of the Code of Criminal Procedure and the timely transmission thereof to the public prosecutor's office referred to in Article 46, fifth paragraph.
Our Minister may lay down further rules regarding the investigation that forms the basis for the advice or report referred to in Article 509o, paragraph 4, of the Code of Criminal Procedure.
Indien het openbaar ministerie naar aanleiding van het voorlopig advies, bedoeld in artikel 47, voornemens is een vordering tot verlenging van de terbeschikkingstelling in te dienen waardoor de totale duur van de terbeschikkingstelling een periode van vier jaar of een veelvoud van vier jaar te boven gaat, doet het daarvan zo spoedig mogelijk mededeling aan Onze Minister.
Na ontvangst van de mededeling, bedoeld in het eerste lid, draagt Onze Minister zorg voor het tijdig totstandkomen van een advies of rapport van deskundigen als bedoeld in artikel 509o, vierde lid, van het Wetboek van Strafvordering en voor tijdige toezending daarvan aan het openbaar ministerie, bedoeld in artikel 46, vijfde lid.
Onze Minister kan nadere regels stellen omtrent het onderzoek dat ten grondslag ligt aan het advies of rapport, bedoeld in artikel 509o, vierde lid, van het Wetboek van Strafvordering.
