Incidental leave shall be requested in writing by the juvenile from the director.
If the petition concerns a juvenile in provisional detention, the director shall request the consent of the Public Prosecution Service.
If the petition concerns a juvenile placed under civil law, the director shall request the consent of the certified institution involved.
If the petition concerns a juvenile who, following the execution of the custodial sentence or custodial measure, is to leave the Netherlands, or is to be deported or extradited, the director shall request advice from the Immigration and Naturalisation Service of the Ministry of Security and Justice.
Het incidenteel verlof wordt door de jeugdige schriftelijk aangevraagd bij de directeur.
Indien het verzoek een voorlopig gehechte jeugdige betreft, vraagt de directeur instemming van het openbaar ministerie.
Indien het verzoek een civielrechtelijk geplaatste jeugdige betreft, vraagt de directeur instemming van de betrokken gecertificeerde instelling.
Indien het verzoek een jeugdige betreft die na de tenuitvoerlegging van de vrijheidsstraf of vrijheidsbenemende maatregel Nederland zal dienen te verlaten, of uitgezet of uitgeleverd zal worden, vraagt de directeur de Immigratie- en Naturalisatiedienst van het Ministerie van Veiligheid en Justitie om advies.
