In deciding whether to provide a juvenile with the opportunity to participate in an education and training program, the director shall, in any event, take into account the following aspects:
the conduct of the juvenile, the juvenile's compliance with agreements, and the juvenile's motivation to participate in an education and training programme;
the extent to which the juvenile, during his participation, can be deemed capable of bearing the responsibility associated with the greater freedoms;
a suitable residential address;
the suitability of the minor for a specific education and training programme.
In the case of juveniles who are detained in the institution on criminal law grounds, the director shall also take into account the following aspects:
the nature, the gravity and the background of the committed offence;
the current course of detention;
the risk of recidivism.
The director shall not take a decision regarding participation in an education and training programme until the juvenile has declared in writing their willingness to participate in the programme and to comply with the conditions attached thereto.
The director shall notify in writing the Child Care and Protection Board (Raad voor de Kinderbescherming), insofar as it concerns minors, the public prosecution service at the court that took cognizance in the first instance of the criminal offence for which the measure of placement in an institution for juveniles was ordered, and the public prosecution service in the district where the juvenile will reside during the education and training programme, of his decision.
At the commencement of the education and training programme, the juvenile shall receive from the director a written statement in which the activities of the education and training programme and the conditions attached thereto are stated, as well as the grounds upon which participation in the education and training programme may be terminated.
Bij zijn beslissing om een jeugdige in de gelegenheid te stellen deel te nemen aan een scholings- en trainingsprogramma betrekt de directeur in ieder geval de volgende aspecten:
het gedrag van de jeugdige, het nakomen van afspraken door de jeugdige en diens gemotiveerdheid om aan een scholings- en trainingsprogramma deel te nemen;
de mate waarin de jeugdige tijdens zijn deelname in staat kan worden geacht de met de grotere vrijheden gepaard gaande verantwoordelijkheid te dragen;
een aanvaardbaar verblijfadres;
de geschiktheid van de jeugdige voor een bepaald scholings- en trainingsprogramma.
Bij jeugdigen die op strafrechtelijke titel in de inrichting verblijven betrekt de directeur tevens de volgende aspecten:
de aard, de zwaarte en de achtergronden van het gepleegde delict;
het huidige detentieverloop;
het gevaar voor recidive.
De directeur neemt zijn beslissing over deelname aan een scholings- en trainingsprogramma niet dan nadat de jeugdige zich schriftelijk bereid heeft verklaard tot deelname aan het programma en naleving van de daaraan verbonden voorwaarden.
De directeur stelt de raad voor de kinderbescherming voor zover het betreft minderjarige jeugdigen, het openbaar ministerie bij de rechtbank die in eerste aanleg kennis heeft genomen van het misdrijf terzake waarvan de maatregel van plaatsing in een inrichting voor jeugdigen is gelast, en het openbaar ministerie in het arrondissement waarin de jeugdige tijdens het scholings- en trainingsprogramma zal verblijven, schriftelijk in kennis van zijn beslissing.
Bij aanvang van het scholings- en trainingsprogramma ontvangt de jeugdige van de directeur een schriftelijke verklaring waarin de activiteiten van het scholings- en trainingsprogramma en de daaraan verbonden voorwaarden zijn vermeld, benevens de gronden waarop de deelname aan het scholings- en trainingsprogramma kan worden beëindigd.
