If the conditions of Article 46c, points (b) and (c), are not met, medical treatment may nevertheless take place as a last resort:
insofar as it is plausible that, without that medical treatment, the danger which the mental disorder, psychogeriatric condition or intellectual disability causes the detainee to pose cannot be averted within a reasonable period, or
if the director has taken a decision to that effect and, in the judgment of a physician, this is strictly necessary to avert the danger that the mental disorder, psychogeriatric condition or intellectual disability causes the detainee to pose within the institution.
Indien niet voldaan wordt aan de voorwaarden van artikel 46c, onderdelen b en c, kan als uiterste redmiddel niettemin geneeskundige behandeling plaatsvinden:
voor zover aannemelijk is dat zonder die geneeskundige behandeling het gevaar dat de psychische stoornis, psychogeriatrische aandoening of verstandelijke handicap de gedetineerde doet veroorzaken niet binnen een redelijke termijn kan worden weggenomen, of
indien de directeur daartoe een besluit heeft genomen en dit naar het oordeel van een arts volstrekt noodzakelijk is om het gevaar dat de psychische stoornis, psychogeriatrische aandoening of verstandelijke handicap de gedetineerde binnen de inrichting doet veroorzaken, af te wenden.
