For each institution or department, a supervisory committee shall be established by Our Minister.
The supervisory committee is tasked with:
to supervise the manner in which the deprivation of liberty is executed within the institution or department and the transport carried out by the institution;
to take cognizance of the grievances brought forward by the detainees;
to ensure the handling of petitions (complaints) pursuant to the provisions of Chapter XI;
to provide advice and information to Our Minister, the Council and the director regarding the matter referred to under (a).
The supervisory committee shall regularly inform itself of the wishes and sentiments prevailing among the detainees through personal contact with them. For this purpose, one of its members shall act as the monthly commissioner on a rotating basis.
Rules regarding the powers, composition, and working methods of the committee, the appointment and dismissal of its members, as well as the activities of the monthly commissioner (maandcommissaris), shall be established by Order in Council.
Bij elke inrichting dan wel afdeling wordt door Onze Minister een commissie van toezicht ingesteld.
De commissie van toezicht heeft tot taak:
toezicht te houden op de wijze van tenuitvoerlegging van de vrijheidsbeneming in de inrichting of afdeling en het vervoer uitgevoerd door de inrichting;
kennis te nemen van door de gedetineerden naar voren gebrachte grieven;
zorg te dragen voor de behandeling van klaagschriften ingevolge het bepaalde in hoofdstuk Xl;
aan Onze Minister, de Raad en de directeur advies en inlichtingen te geven omtrent het onder a gestelde.
De commissie van toezicht stelt zich door persoonlijk contact met de gedetineerden regelmatig op de hoogte van onder hen levende wensen en gevoelens. Bij toerbeurt treedt één van haar leden hiertoe op als maandcommissaris.
Bij algemene maatregel van bestuur worden regels gesteld over de bevoegdheden, de samenstelling en de werkwijze van de commissie, de benoeming en het ontslag van haar leden alsmede over de werkzaamheden van de maandcommissaris.
