The ruling containing the decision regarding the surrender must be rendered by the court no later than sixty days after the arrest of the requested person, as referred to in Article 21.
If the surrender is also dependent on the consent of the competent authority of another Member State or of a third state, the time limit referred to in the first paragraph shall commence on the day on which the required consent is received.
In specific cases and stating the reasons to the issuing judicial authority, the court may extend the period of sixty days by a maximum of thirty days.
In exceptional cases, the court may, until it renders its decision, extend the period referred to in the third paragraph by a maximum of sixty days at a time, subject to the fifth paragraph. An exceptional case shall in any event exist if:
the court has not yet been able to render a decision within the period referred to in the third paragraph, because it intends to refer one or more preliminary questions to the Court of Justice of the European Union or is awaiting a ruling from that Court on preliminary questions that are relevant to its decision;
the court has not yet been able to render a decision within the time limit referred to in the third paragraph, because it is conducting an investigation into a real risk of a violation of the fundamental rights of the requested person, as referred to in Article 11, paragraph 1;
the court has adjourned its decision pursuant to Article 11, paragraph 2.
In the exceptional case referred to in paragraph 4, point (b), the court may extend the time limit by a maximum of thirty days at a time, until the investigation has been completed and the court renders its decision.
In the event of an extension of the time limit as referred to in the fourth and fifth paragraphs, the public prosecutor shall notify Eurojust and the issuing judicial authority thereof without delay, stating the reasons for the delay.
De uitspraak, houdende de beslissing over de overlevering dient door de rechtbank te worden gedaan uiterlijk zestig dagen na de aanhouding van de opgeëiste persoon, bedoeld in artikel 21.
Indien de overlevering mede afhankelijk is van de instemming van de bevoegde autoriteit van een andere lidstaat of van een derde staat, begint de in het eerste lid genoemde termijn te lopen vanaf de dag dat de vereiste instemming is ontvangen.
In specifieke gevallen en onder opgave van redenen aan de uitvaardigende justitiële autoriteit kan de rechtbank de termijn van zestig dagen met maximaal dertig dagen verlengen.
In uitzonderlijke gevallen kan de rechtbank, totdat zij uitspraak doet, de in het derde lid bedoelde termijn met telkens maximaal zestig dagen verlengen, behoudens het vijfde lid. Van een uitzonderlijk geval is in ieder geval sprake indien:
de rechtbank binnen de in het derde lid bedoelde termijn nog geen uitspraak heeft kunnen doen, omdat zij voornemens is om een of meer prejudiciële vragen voor te leggen aan het Hof van Justitie van de Europese Unie of in afwachting is van een uitspraak van dat Hof over prejudiciële vragen die relevant zijn voor haar beslissing;
de rechtbank binnen de in het derde lid bedoelde termijn nog geen uitspraak heeft kunnen doen, omdat zij onderzoek doet naar een reëel gevaar van schending van de grondrechten van de opgeëiste persoon, als bedoeld in artikel 11, eerste lid;
de rechtbank haar beslissing heeft aangehouden krachtens artikel 11, tweede lid.
In het uitzonderlijke geval, bedoeld in het vierde lid, onderdeel b, kan de rechtbank de termijn met telkens maximaal dertig dagen verlengen, totdat het onderzoek is afgerond en de rechtbank uitspraak doet.
In geval van verlenging van de termijn als bedoeld in het vierde en vijfde lid stelt de officier van justitie Eurojust en de uitvaardigende justitiële autoriteit daarvan onverwijld in kennis, onder opgave van de redenen voor de vertraging.
