in forceIf a trade name is used contrary to Articles 5 or 5a, the court may, in appropriate cases, determine the damages as a lump sum.
The court may, upon the claim of the person using the trade name, order that, at the expense of the person who has acted contrary to Articles 3 up to and including 5b, appropriate measures be taken for the dissemination of information concerning the judgment.
Indien een handelsnaam wordt gevoerd in strijd met de artikelen 5 of 5a, kan de rechter in passende gevallen de schadevergoeding vaststellen als een forfaitair bedrag.
De rechter kan op vordering van degene die de handelsnaam voert gelasten dat op kosten van degene die heeft gehandeld in strijd met de artikelen 3 tot en met 5b passende maatregelen worden getroffen tot verspreiding van informatie over de uitspraak.
