The General Time Limits Act does not apply to the time limits set in Articles 39, 40, 238, 239 and 305.
Title 3 of Book 1 of the Code of Civil Procedure does not apply to petitions (applications) pursuant to this Act, with the exception of Articles 262 and 269 of that Code insofar as it concerns petitions (applications) which are submitted on the basis of Section 2 of Title IV in the context of a private composition procedure outside bankruptcy or a public composition procedure outside bankruptcy.
The court refuses homologation of an agreement referred to in this Act if the agreement does not provide for the repayment of the State aid which must be recovered pursuant to a Commission decision as referred to in Article 1 of the State Aid Recovery Act.
De Algemene termijnenwet is niet van toepassing op de termijnen, gesteld in de artikelen 39, 40, 238, 239 en 305.
De derde titel van het eerste boek van het Wetboek van Burgerlijke Rechtsvordering is niet van toepassing op verzoeken ingevolge deze wet, met uitzondering van de artikelen 262 en 269 van dat wetboek voor zover het verzoeken betreft die op basis van de tweede afdeling van titel IV worden ingediend in het kader van een besloten akkoordprocedure buiten faillissement of een openbare akkoordprocedure buiten faillissement.
De rechtbank weigert homologatie van een akkoord, bedoeld in deze wet, indien het akkoord niet voorziet in de terugbetaling van de staatssteun die ingevolge een Commissiebesluit als bedoeld in artikel 1 van de Wet terugvordering staatssteun moet worden teruggevorderd.
