In the event of the rejection of the declaration or petition for a declaration of bankruptcy, a right of appeal exists for eight days after the day of the rejection.
The same applies in the event of the annulment of the declaration of bankruptcy as a result of opposition, in which case notice of the appeal is given without delay by the registrar of the court of appeal where it has been lodged, to the registrar of the court which pronounced the annulment.
The institution and hearing of the appeal take place in the manner prescribed in Articles 4 and 6.
Bij afwijzing van de aangifte of aanvraag tot faillietverklaring bestaat recht van hoger beroep, gedurende acht dagen na de dag der afwijzing.
Hetzelfde geldt bij vernietiging der faillietverklaring ten gevolge van verzet, in welk geval van het hoger beroep door de griffier van het gerechtshof, waarbij het is aangebracht, onverwijld wordt kennis gegeven aan de griffier van de rechtbank die de vernietiging heeft uitgesproken.
De instelling en behandeling van het hoger beroep geschiedt op de wijze in de artikelen 4 en 6 voorgeschreven.
