The supervisory judge is authorised, for the clarification of all circumstances concerning the bankruptcy, to hear witnesses or to order an investigation by experts. Furthermore, the supervisory judge may appoint an expert insofar as this is necessary for the proper and effective performance of the supervision of the management and the liquidation of the bankrupt estate. The costs in connection with the appointment of the expert shall be borne by the estate.

The witnesses are summoned by writ on behalf of the delegated judge. Article 177 of the Code of Civil Procedure applies mutatis mutandis.

In the event of non-appearance or refusal to take the oath or give evidence, Articles 171, 172, 173, paragraph 1, first sentence, paragraphs 2 and 3, 174 and 175 of the Code of Civil Procedure are applicable.

The spouse or former spouse of the bankrupt or the person with whom the bankrupt has or had entered into a registered partnership, the children and further descendants and the parents and grandparents of the bankrupt may excuse themselves from giving testimony.

De rechter-commissaris is bevoegd ter opheldering van alle omstandigheden, het faillissement betreffende, getuigen te horen of een onderzoek van deskundigen te bevelen. Voorts kan de rechter-commissaris een deskundige benoemen voor zover dit nodig is voor de goede en effectieve vervulling van het toezicht op het beheer en de vereffening van de failliete boedel. De kosten in verband met de benoeming van de deskundige komen ten laste van de boedel.

De getuigen worden bij exploot opgeroepen namens de rechter-commissaris. Artikel 177 van het Wetboek van Burgerlijke Rechtsvordering is van overeenkomstige toepassing.

Bij niet-verschijning of weigering om de eed of getuigenis af te leggen, zijn de artikelen 171, 172, 173, eerste lid, eerste volzin, tweede en derde lid, 174 en 175 van het Wetboek van Burgerlijke Rechtsvordering toepasselijk.

De echtgenoot of gewezen echtgenoot van de gefailleerde of degene met wie de gefailleerde een geregistreerd partnerschap is of was aangegaan, de kinderen en verdere afkomelingen en de ouders en grootouders van de gefailleerde kunnen zich van het geven van getuigenis verschonen.
