For claims which the counterparty has acquired against the debtor by virtue of the dissolution or annulment of an agreement concluded with the latter prior to the declaration of bankruptcy, or which seek damages in respect of a failure in the performance of a claim acquired against the latter prior to the declaration of bankruptcy, it may present itself as an unsecured creditor in the bankruptcy.
Voor vorderingen die de wederpartij uit hoofde van ontbinding of vernietiging van een vóór de faillietverklaring met de schuldenaar gesloten overeenkomst op deze heeft verkregen, of die strekken tot schadevergoeding ter zake van tekortschieten in de nakoming van een vóór de faillietverklaring op deze verkregen vordering, kan zij als concurrent schuldeiser in het faillissement opkomen.
