Notwithstanding Article 2, paragraph 1, the declaration of bankruptcy of a central counterparty established in the Netherlands is pronounced by the District Court of Amsterdam.

A central counterparty established in a Member State other than the Netherlands that has obtained a licence there cannot be declared bankrupt in the Netherlands.

In afwijking van artikel 2, eerste lid, geschiedt de faillietverklaring van een in Nederland gevestigde centrale tegenpartij door de rechtbank Amsterdam.
2.
Een in een andere lidstaat dan Nederland gevestigde centrale tegenpartij die daar een vergunning heeft verkregen kan in Nederland niet in staat van faillissement worden verklaard.
