If the amount that a creditor has received in interim periodic payments is greater than the amount for which his claim is verified, and prior to the verification meeting claims under insurance have been transferred to a transferee, the bankruptcy trustee has, if he has not agreed otherwise with the transferee, a claim against the transferee in respect of the amount that he can no longer set off because the claims under insurance and assets have been transferred.
The transferee may deduct the amount that he has paid to the bankruptcy trustee on the claim referred to in the first paragraph, in instalments, from the payments that he owes under the insurance contract with the relevant creditor that has been transferred to him.
Indien het bedrag dat een schuldeiser aan tussentijdse periodieke uitkeringen heeft ontvangen groter is dan het bedrag waarvoor zijn vordering wordt geverifieerd, en voorafgaand aan de verificatievergadering vorderingen uit hoofde van verzekering zijn overgedragen aan een overnemer, heeft de curator, indien hij niet anders is overeengekomen met de overnemer, ter zake van het bedrag dat hij niet meer kan verrekenen doordat de vorderingen uit hoofde van verzekering en activa zijn overgedragen, een vordering op de overnemer.
De overnemer kan het bedrag dat hij op de vordering, bedoeld in het eerste lid, heeft voldaan aan de curator, in termijnen in mindering brengen op de uitkeringen die hij is verschuldigd uit hoofde van de op hem overgegane overeenkomst van verzekering met de desbetreffende schuldeiser.
