The trustee (curator) draws up the distribution list each time and submits it for the approval of the supervisory judge (rechter-commissaris). The list contains a statement of receipts and expenditures (including the salary of the trustee), the names of the creditors, the verified amount of their claims or alternatively the amount of the claims to which they lay claim as entitled parties under the agreement referred to in Article 110, paragraph 3, as well as the distribution to be received thereon.
For the unsecured creditors, the percentages to be determined by the supervisory judge are set aside. For the creditors who have priority, regardless of whether this is disputed, and who have not already been satisfied in accordance with Article 57 or 60 paragraph 3, the amount is set aside for which they can be beneficially ranked from the proceeds of the assets to which their priority relates. If this is less than the entire amount of their claims, percentages equal to those for the unsecured creditors are set aside for the shortfall - or, if the assets to which their claim relates have not yet been sold, for their entire claim.
De curator maakt telkens de uitdelingslijst op en onderwerpt die aan de goedkeuring van de rechter-commissaris. De lijst houdt in een staat der ontvangsten en uitgaven (daaronder begrepen het salaris van de curator), de namen der schuldeisers, het geverifieerde bedrag van hun vorderingen dan wel het bedrag van de vorderingen waarop zij als gerechtigden onder de in artikel 110, derde lid, bedoelde overeenkomst aanspraak maken, benevens de daarop te ontvangen uitkering.
Voor de concurrente schuldeisers worden de door de rechter-commissaris te bepalen percenten uitgetrokken. Voor de schuldeisers die voorrang hebben, ongeacht of deze betwist wordt, en die niet reeds overeenkomstig artikel 57 of 60 lid 3 voldaan zijn wordt het bedrag uitgetrokken waarvoor zij batig gerangschikt kunnen worden op de opbrengst der goederen waarop hun voorrang betrekking heeft. Zo dit minder is dan het gehele bedrag van hun vorderingen, worden voor het ontbrekende - zo de goederen waarop hun vordering betrekking heeft nog niet verkocht zijn, voor hun hele vordering - gelijke percenten als voor de concurrente schuldeisers uitgetrokken.
