For the purposes of Articles 106a up to and including 106c, the person who has determined or co-determined the policy of the legal entity as if he were a director shall also be regarded as a director.
For the purposes of Articles 106a up to and including 106c, the executive director is equated with a director and the non-executive director with a supervisory director, if the management duties are divided among executive and non-executive directors.
Voor de toepassing van de artikelen 106a tot en met 106c wordt als bestuurder tevens aangemerkt degene die het beleid van de rechtspersoon heeft bepaald of mede heeft bepaald als ware hij bestuurder.
Voor de toepassing van de artikelen 106a tot en met 106c wordt met bestuurder gelijk gesteld de uitvoerende bestuurder en met de commissaris de niet uitvoerende bestuurder, indien de bestuurstaken zijn verdeeld over uitvoerende en niet uitvoerende bestuurders.
