Article 7:322

Where the provisions of Article 321, paragraph 1, have not been complied with, the lessor may not, as long as the lease agreement (pachtovereenkomst) has not been approved by the agricultural tenancy board (grondkamer), institute a legal action for payment of the rent against the lessee, and the lease agreement shall apply for an indefinite period, without being subject to termination by notice by either of the parties; if approval is granted, the duration referred to in Article 325 shall commence at the start of the lease year following the year in which the agreement was submitted.
The grondkamer is authorised, upon the petition of a party in special cases, to determine at the time of approval that the duration referred to in Article 325 shall commence at an earlier date.
Wanneer niet is voldaan aan het bepaalde in artikel 321 lid 1 kan de verpachter, zolang de pachtovereenkomst door de grondkamer niet is goedgekeurd, niet een rechtsvordering tot betaling van de pachtprijs tegen de pachter instellen en geldt de pachtovereenkomst voor onbepaalde tijd, zonder dat zij door een van de partijen kan worden opgezegd; wordt de goedkeuring verleend, dan gaat de in artikel 325 bedoelde duur in bij de aanvang van het pachtjaar, volgende op dat, waarin de overeenkomst is ingezonden.
De grondkamer is bevoegd op verzoek van een partij in bijzondere gevallen bij de goedkeuring te bepalen, dat de in artikel 325 bedoelde duur op een eerder tijdstip ingaat.
