The debtor who has failed in the performance of his obligation may set a reasonable period for the creditor within which the latter must communicate which of the remedies available to him at the commencement of the period he wishes to exercise, on pain of being entitled only to claim:
to the damages to which the non-performance gives rise and, if the obligation extends to the payment of a sum of money, to that sum of money;
to the dissolution of the agreement from which the obligation arises, if the debtor relies on the fact that the failure in performance cannot be attributed to him.
If the creditor has demanded performance, but such demand is not complied with within a reasonable period, he may again assert all his rights; the preceding paragraph shall apply mutatis mutandis.
De schuldenaar die in de nakoming van zijn verbintenis is tekort geschoten, kan aan de schuldeiser een redelijke termijn stellen, waarbinnen deze moet mededelen welke van de hem bij de aanvang van de termijn ten dienste staande middelen hij wenst uit te oefenen, op straffe van slechts aanspraak te kunnen maken:
op de schadevergoeding waarop de tekortkoming recht geeft en, zo de verbintenis strekt tot betaling van een geldsom, op die geldsom;
op ontbinding van de overeenkomst waaruit de verbintenis voortspruit, indien de schuldenaar zich erop beroept dat de tekortkoming hem niet kan worden toegerekend.
Heeft de schuldeiser nakoming verlangd, doch wordt daaraan niet binnen een redelijke termijn voldaan, dan kan hij al zijn rechten wederom doen gelden; het vorige lid is van overeenkomstige toepassing.
