The creditor can no longer invoke a defect in the performance if he has not protested to the debtor in respect thereof within a reasonable time after he has discovered or reasonably should have discovered the defect.
De schuldeiser kan op een gebrek in de prestatie geen beroep meer doen, indien hij niet binnen bekwame tijd nadat hij het gebrek heeft ontdekt of redelijkerwijze had moeten ontdekken, bij de schuldenaar terzake heeft geprotesteerd.
