The creditor also enters into default if, as a consequence of circumstances attributable to him, he fails to comply with an obligation on his part towards the debtor and the latter, on that ground, is entitled to suspend the performance of his obligation towards the creditor.
De schuldeiser komt eveneens in verzuim, wanneer hij ten gevolge van hem toe te rekenen omstandigheden niet voldoet aan een verplichting zijnerzijds jegens de schuldenaar en deze op die grond bevoegdelijk de nakoming van zijn verbintenis jegens de schuldeiser opschort.
