The creditor enters into default (schuldeisersverzuim) when performance of the obligation is prevented because he fails to provide the necessary cooperation or because another obstacle on his part arises, unless the cause of the prevention cannot be attributed to him.
De schuldeiser komt in verzuim, wanneer nakoming van de verbintenis verhinderd wordt doordat hij de daartoe noodzakelijke medewerking niet verleent of doordat een ander beletsel van zijn zijde opkomt, tenzij de oorzaak van verhindering hem niet kan worden toegerekend.
