When it follows from the law that a person is obliged to provide security or that the provision of security is a condition for the occurrence of any legal effect, the person who proceeds to do so has the choice between personal and real security.
The security offered must be such that the claim and, if there are grounds therefor, the interest and costs due thereon are properly covered and that the creditor will be able to seek recourse therefrom without difficulty.
If the security provided has become insufficient due to a cause not attributable to the creditor, the debtor is obliged to supplement or replace it.
Wanneer uit de wet voortvloeit dat iemand verplicht is tot het stellen van zekerheid of dat het stellen van zekerheid voorwaarde is voor het intreden van enig rechtsgevolg, heeft hij die daartoe overgaat, de keuze tussen persoonlijke en zakelijke zekerheid.
De aangeboden zekerheid moet zodanig zijn, dat de vordering en, zo daartoe gronden zijn, de daarop vallende rente en kosten behoorlijk gedekt zijn en dat de schuldeiser daarop zonder moeite verhaal zal kunnen nemen.
Is de gestelde zekerheid door een niet aan de schuldeiser toe te rekenen oorzaak onvoldoende geworden, dan is de schuldenaar verplicht haar aan te vullen of te vervangen.
