A debtor who has an enforceable claim against his creditor is authorised to suspend the performance of his obligation until satisfaction of his claim takes place, if there is sufficient connection between the claim and the obligation to justify this suspension.
Such a connection may be assumed, inter alia, in the event that the obligations on both sides arise from the same legal relationship or from transactions which the parties have regularly conducted with each other.
Een schuldenaar die een opeisbare vordering heeft op zijn schuldeiser, is bevoegd de nakoming van zijn verbintenis op te schorten tot voldoening van zijn vordering plaatsvindt, indien tussen vordering en verbintenis voldoende samenhang bestaat om deze opschorting te rechtvaardigen.
Een zodanige samenhang kan onder meer worden aangenomen ingeval de verbintenissen over en weer voortvloeien uit dezelfde rechtsverhouding of uit zaken die partijen regelmatig met elkaar hebben gedaan.
