An owner, a holder of a right of ground lease (erfpachter), or a holder of a right of superficies (opstaller) is authorised to divide their right to a building with its appurtenances and to the land belonging thereto with its appurtenances into apartment rights.
An owner, a holder of a right of ground lease (erfpacht), or a holder of a right of superficies (opstal) is likewise authorised to divide their right to a piece of land into apartment rights.
An apartment right is in turn susceptible to subdivision into apartment rights. An apartment owner is authorised to effect this subdivision, insofar as the deed of division does not provide otherwise.
Apartment rights are understood to mean a share in the property involved in the division, which includes the authority to the exclusive use of specific parts of the building that, according to their layout, are intended or are being intended to be used as a separate unit. The share may also include the authority to the exclusive use of specific parts of the land belonging to the building. In the case of paragraph 2, the share includes the authority to the exclusive use of specific parts of the plot of land which, according to their layout or designation, are intended or are being intended to be used as a separate unit.
For the purposes of this Title, an apartment owner (appartementseigenaar) shall be understood to mean the person entitled to an apartment right (appartementsrecht).
For the purposes of this Title, the term 'building' also includes a group of buildings that are included in a single deed of division.
A long leaseholder (erfpachter) or a holder of a right of superficies (opstaller) is only authorised to effect a division into apartment rights after having obtained the consent of the landowner. If the latter refuses the required consent manifestly without reasonable grounds or fails to make a declaration, the consent may, at the request of the person who requires it, be replaced by an authorisation from the subdistrict court judge (kantonrechter) of the court (de rechtbank) within whose jurisdiction the building or the largest part thereof is situated.
Een eigenaar, erfpachter of opstaller is bevoegd zijn recht op een gebouw met toebehoren en op de daarbij behorende grond met toebehoren te splitsen in appartementsrechten.
Een eigenaar, erfpachter of opstaller is eveneens bevoegd zijn recht op een stuk grond te splitsen in appartementsrechten.
Een appartementsrecht is op zijn beurt voor splitsing in appartementsrechten vatbaar. Een appartementseigenaar is tot deze ondersplitsing bevoegd, voor zover in de akte van splitsing niet anders is bepaald.
Onder appartementsrecht wordt verstaan een aandeel in de goederen die in de splitsing zijn betrokken, dat de bevoegdheid omvat tot het uitsluitend gebruik van bepaalde gedeelten van het gebouw die blijkens hun inrichting bestemd zijn of worden om als afzonderlijk geheel te worden gebruikt. Het aandeel kan mede omvatten de bevoegdheid tot het uitsluitend gebruik van bepaalde gedeelten van de bij het gebouw behorende grond. In het geval van lid 2 omvat het aandeel de bevoegdheid tot het uitsluitend gebruik van bepaalde gedeelten van het stuk grond, die blijkens hun inrichting of aanduiding bestemd zijn of worden om als afzonderlijk geheel te worden gebruikt.
Onder appartementseigenaar wordt verstaan de gerechtigde tot een appartementsrecht.
Onder gebouw wordt in deze titel mede verstaan een groep van gebouwen die in één splitsing zijn betrokken.
Een erfpachter of opstaller is tot een splitsing in appartementsrechten slechts bevoegd na verkregen toestemming van de grondeigenaar. Indien deze de vereiste toestemming kennelijk zonder redelijke grond weigert of zich niet verklaart, kan de toestemming op verzoek van degene die haar behoeft worden vervangen door een machtiging van de kantonrechter van de rechtbank van het arrondissement waarin het gebouw of het grootste gedeelte daarvan is gelegen.
