When a person charged with the investigation is refused access to the books, documents and other data carriers or is refused the inspection of the assets in accordance with the previous article, the delegated judge (raadsheer-commissaris) referred to in Article 350, paragraph 4, shall, at the petition of that person, issue such orders as the circumstances may require.

The orders may include a mandate to the public authorities to provide assistance as far as necessary and the authority to enter a dwelling, when the place where the books, documents and other data carriers or the assets are located is a dwelling, or is only accessible through a dwelling. The dwelling shall not be entered against the will of the occupant except upon production of the authority issued by the delegated judge (raadsheer-commissaris).

Wanneer aan een met het onderzoek belaste persoon wordt geweigerd overeenkomstig het vorige artikel de boeken, bescheiden en andere gegevensdragers te raadplegen of zich de bezittingen te doen tonen, geeft de de raadsheer-commissaris bedoeld in artikel 350 lid 4 op verzoek van die persoon de bevelen die de omstandigheden nodig maken.

De bevelen kunnen inhouden de opdracht aan de openbare macht om voor zoveel nodig bijstand te verlenen en de last om een woning binnen te treden, wanneer de plaats waar de boeken, bescheiden en andere gegevensdragers of de bezittingen zich bevinden, een woning is, of alleen door een woning toegankelijk. De woning wordt niet tegen de wil van de bewoner binnengetreden dan na vertoon van de last van de raadsheer-commissaris.
