It may be stipulated in the agreement that it cannot be modified by judicial decision on the grounds of a change of circumstances. Such a stipulation may only be made in writing.
The stipulation lapses if the agreement has been entered into before the filing of the petition for divorce, unless it is filed within three months after the agreement. The foregoing applies mutatis mutandis to a joint petition.
Notwithstanding such a stipulation, the agreement may, upon the petition of one of the parties, be modified by the court in the divorce order or by a subsequent order on the ground of such a profound change of circumstances that the petitioner, according to standards of reasonableness and fairness, may no longer be held to the stipulation.
Bij de overeenkomst kan worden bedongen dat zij niet bij rechterlijke uitspraak zal kunnen worden gewijzigd op grond van een wijziging van omstandigheden. Een zodanig beding kan slechts schriftelijk worden gemaakt.
Het beding vervalt, indien de overeenkomst is aangegaan vóór de indiening van het verzoek tot echtscheiding, tenzij dit binnen drie maanden na de overeenkomst is ingediend. Het voorgaande is van overeenkomstige toepassing bij een gemeenschappelijk verzoek.
Ondanks een zodanig beding kan op verzoek van een der partijen de overeenkomst door de rechter bij de echtscheidingsbeschikking of bij latere beschikking worden gewijzigd op grond van een zo ingrijpende wijziging van omstandigheden, dat de verzoeker naar maatstaven van redelijkheid en billijkheid niet langer aan het beding mag worden gehouden.
