Before or after the decree of divorce, the spouses may determine by agreement whether, and if so to what amount, after the divorce one shall be obliged towards the other to provide an allowance for their maintenance. If no term is included in the agreement, Article 157, paragraphs 1 to 5 inclusive and paragraph 7, shall apply mutatis mutandis.

Family law. Spousal maintenance. The period of 12 years under Article 1:157 paragraph 4 of the Civil Code (Burgerlijk Wetboek) and the period of 3 months under Article 1:157 paragraph 5 of the Civil Code must be classified as periods of limitation (vervaltermijnen). When maintenance payments are terminated after the expiry of the twelve-year period under Article 1:157 paragraph 4 of the Civil Code, the maintenance obligation shall lapse by operation of law, unless a petition for extension has been filed within the three-month period. If one or more payments have nonetheless taken place, it must be assumed that those payments are based on a tacit agreement to continue the maintenance obligation, unless the person liable for maintenance states at the time of payment that it is based on a different title. In the absence of such a statement, the three-month period under the fifth paragraph of Article 1:157 of the Civil Code shall commence at the time of the last payment.
