The spouse who wishes to avail themselves of the privilege described in the preceding article is obliged, within three months after the dissolution of the community, to cause a deed of renunciation to be registered in the matrimonial property register designated in Article 116 of this Book, on pain of forfeiture of this privilege.
If the community is dissolved by the death of the other spouse, the three-month period shall begin to run on the day on which the spouse wishing to exercise the privilege has become aware of that death. If the community has been dissolved in the manner referred to in Article 99, paragraph 1, under (c) and (d), the period shall end three months after the petition for the termination of the community or for legal separation (scheiding van tafel en bed) has been filed with the court.
De echtgenoot die van het bij het vorige artikel omschreven voorrecht wil gebruik maken, is verplicht binnen drie maanden na de ontbinding der gemeenschap een akte van afstand te doen inschrijven in het huwelijksgoederenregister, aangewezen in artikel 116 van dit boek, op verbeurte van dit voorrecht.
Indien de gemeenschap door de dood van de andere echtgenoot wordt ontbonden, begint de termijn van drie maanden te lopen op de dag waarop de echtgenoot die van het voorrecht wil gebruik maken, van dat overlijden kennis heeft genomen. Indien de gemeenschap is ontbonden op de wijze als bedoeld in artikel 99, eerste lid, onder c en d, eindigt de termijn drie maanden nadat het verzoek tot opheffing van de gemeenschap of tot scheiding van tafel en bed bij de rechtbank is ingediend.
