Article 1:451

Mentorship may be petitioned for by the person concerned, his spouse, his registered partnership (geregistreerd partnerschap) or other life companion, his relatives by blood in the direct line and those in the collateral line up to and including the fourth degree, the person who exercises authority over the person concerned pursuant to Article 253sa or 253t, his guardian, his curator or his administrator (bewindvoerder) as referred to in Title 19 of this Book. In the case referred to in Article 450, paragraph 3, of this Book, mentorship may be petitioned for exclusively by the person concerned.
Mentorship may, except in the case referred to in Article 450, paragraph 3, furthermore be petitioned for by the Public Prosecution Service and by the institution where the person concerned is being cared for or which provides guidance to the person concerned. In the latter case, the petition shall also state why the persons mentioned in the first paragraph - excluding collateral relatives in the third and fourth degree - have not proceeded to file a petition.
The court before which a petition for a protective guardianship (ondercuratelestelling) or for the termination of the protective guardianship is pending, may, upon the dismissal or the granting thereof respectively, ex officio proceed to the establishment of a mentorship (mentorschap).
A petition for the conversion of curatorship (curatele) into mentorship (mentorschap) for the benefit of a person who has been placed under curatorship shall be brought before the court that is competent to decide on the termination of the curatorship. This court may, upon the termination of the curatorship, also ex officio proceed to the institution of the mentorship.
The mentorship shall take effect on the day following the date on which the order was issued or dispatched, unless the order specifies a later date of commencement. In the case referred to in Article 450, paragraph 2, of this Book, the mentorship shall take effect at the time the person concerned attains the age of majority.
Het mentorschap kan worden verzocht door de betrokken persoon, zijn echtgenoot, zijn geregistreerde partner dan wel andere levensgezel, zijn bloedverwanten in de rechte lijn en die in de zijlijn tot en met de vierde graad, degene die ingevolge artikel 253sa of 253t het gezag over de betrokken persoon uitoefent, zijn voogd, zijn curator of zijn bewindvoerder als bedoeld in titel 19 van dit boek. In het in artikel 450, derde lid, van dit boek bedoelde geval kan het mentorschap uitsluitend worden verzocht door de betrokkene.
Het mentorschap kan, behoudens in het in artikel 450, derde lid, bedoelde geval, voorts worden verzocht door het openbaar ministerie en door de instelling waar de betrokkene wordt verzorgd of die aan de betrokkene begeleiding biedt. In het laatste geval wordt in het verzoekschrift tevens vermeld waarom de in het eerste lid genoemde personen - bloedverwanten in de zijlijn in de derde en vierde graad daaronder niet begrepen - niet tot indiening van een verzoek zijn overgegaan.
De rechter bij wie een verzoek tot ondercuratelestelling of tot opheffing van de curatele aanhangig is, kan bij afwijzing onderscheidenlijk bij inwilliging daarvan ambtshalve overgaan tot instelling van het mentorschap.
Een verzoek tot omzetting van curatele in mentorschap ten behoeve van een persoon die onder curatele is gesteld, wordt aanhangig gemaakt bij de rechter die bevoegd is over opheffing van de curatele te beslissen. Deze rechter kan, bij opheffing van de curatele, ook ambtshalve overgaan tot instelling van het mentorschap.
Het mentorschap treedt in werking daags nadat de beschikking is verstrekt of verzonden, tenzij de beschikking een later tijdstip van ingang vermeldt. In het geval, bedoeld in artikel 450, tweede lid, van dit boek treedt het mentorschap in werking op het tijdstip waarop de betrokken persoon meerderjarig wordt.
