Mentorship for adults (mentorschap)

If an adult, as a result of his mental or physical condition, is temporarily or permanently unable to properly look after his interests of a non-patrimonial nature, or is hindered in doing so, the subdistrict court (kantonrechter) may establish a mentorship (mentorschap) for his benefit.

If it is to be expected that a minor, at the time at which he will attain the age of majority, will be in the condition referred to in the first paragraph, the mentorship (mentorschap) may already be instituted prior to the age of majority.

Mentorship may also be established if it is to be expected that an adult will, within the foreseeable future, be in the state referred to in the first paragraph.

The court before which a petition for the granting of a judicial authorisation as referred to in the Care and Coercion (Psychogeriatric and Intellectually Disabled Clients) Act (Wet zorg en dwang psychogeriatrische en verstandelijk gehandicapte cliënten), or a care authorisation or an authorisation for the continuation of a crisis measure as referred to in the Compulsory Mental Health Care Act (Wet verplichte geestelijke gezondheidszorg) is pending, shall also have jurisdiction to hear a petition for the establishment of a mentorship.

Indien een meerderjarige als gevolg van zijn geestelijke of lichamelijke toestand tijdelijk of duurzaam niet in staat is of bemoeilijkt wordt zijn belangen van niet-vermogensrechtelijke aard zelf behoorlijk waar te nemen, kan de kantonrechter te zijnen behoeve een mentorschap instellen.

Indien te verwachten is dat een minderjarige op het tijdstip waarop hij meerderjarig zal worden, in de in het eerste lid bedoelde toestand zal verkeren, kan het mentorschap reeds voor de meerderjarigheid worden ingesteld.

Het mentorschap kan eveneens worden ingesteld, indien te verwachten is dat een meerderjarige binnen afzienbare tijd in de in het eerste lid bedoelde toestand zal verkeren.

De rechter bij wie een verzoek tot het verlenen van een rechterlijke machtiging als bedoeld in de Wet zorg en dwang psychogeriatrische en verstandelijk gehandicapte cliënten dan wel een zorgmachtiging of een machtiging tot voorzetting van de crisismaatregel als bedoeld in de Wet verplichte geestelijke gezondheidszorg aanhangig is, is tevens bevoegd tot kennisneming van een verzoek tot instelling van een mentorschap.
