The certified institution requires the authorisation of the children's court for a change in the residence of a minor who has been raised and cared for as a member of the family by a person other than the parent for at least one year.
The authorisation shall be granted by the children's court judge upon petition of the certified institution and shall be denied only if the children's court judge deems this necessary in the interest of the minor.
If the juvenile judge denies the petition referred to in the second paragraph, he may also determine that the supervision order and the authorisation for out-of-home placement shall remain in force for at most one year. The certified institution is obliged to execute the authorisation for out-of-home placement.
De gecertificeerde instelling behoeft de toestemming van de kinderrechter voor wijziging in het verblijf van een minderjarige die ten minste een jaar door een ander dan de ouder is opgevoed en verzorgd als behorende tot zijn gezin.
De toestemming wordt door de kinderrechter op verzoek van de gecertificeerde instelling verleend en slechts afgewezen indien de kinderrechter dit in het belang van de minderjarige noodzakelijk oordeelt.
Indien de kinderrechter het verzoek, bedoeld in het tweede lid, afwijst, kan hij tevens bepalen dat de ondertoezichtstelling en de machtiging tot uithuisplaatsing van kracht blijven voor ten hoogste een jaar. De gecertificeerde instelling is gehouden de machtiging tot uithuisplaatsing ten uitvoer te leggen.
