in forceAt the request of the legal representative, the surname of a minor child shall be changed:
in the same surname as that of the other minor children of the same parents belonging to the same family, if a difference in surname between the children has arisen as a result of the application of rules of private international law; or
in the surname according to the law of a state of which the child possesses the nationality, if the child possesses another nationality in addition to the Dutch nationality, all this with due observance of Articles 12, first paragraph, and 17 of the Treaty establishing the European Community and, where possible, of the equality of surname of minor children of the same parents belonging to the same family.
Article 3, paragraph 5, under (b) through (d), shall apply mutatis mutandis.
For the benefit of children of the same parents who belong to the same family, only identical petitions for a change of surname may be granted on the basis of this Article.
Op verzoek van de wettelijk vertegenwoordiger wordt de geslachtsnaam van een minderjarig kind gewijzigd:
in dezelfde geslachtsnaam als die van de overige tot hetzelfde gezin behorende minderjarige kinderen van dezelfde ouders, indien als gevolg van de toepassing van regels van internationaal privaatrecht verschil in geslachtsnaam tussen de kinderen is ontstaan; of
in de geslachtsnaam naar het recht van een staat waarvan het kind de nationaliteit bezit, indien het kind naast de Nederlandse nationaliteit een andere nationaliteit bezit, een en ander met inachtneming van de artikelen 12, eerste lid, en 17 van het Verdrag tot oprichting van de Europese Gemeenschap en, waar mogelijk, van de gelijkheid van geslachtsnaam van minderjarige kinderen van dezelfde ouders die tot hetzelfde gezin behoren.
Artikel 3, vijfde lid, onder b tot en met d, is van overeenkomstige toepassing.
Ten behoeve van kinderen van dezelfde ouders die tot hetzelfde gezin behoren, kunnen op grond van dit artikel slechts gelijkluidende verzoeken om geslachtsnaamswijziging worden ingewilligd.
