Any person who intentionally and without being entitled to do so removes or alters electronic rights-management information, or distributes, imports for distribution, broadcasts or otherwise makes available to the public literary, scientific or artistic works from which such information has been removed without authorisation or in which such information has been altered without authorisation, and who knows or should reasonably know that he thereby induces an infringement of copyright, or enables, facilitates or conceals such an infringement, acts unlawfully.

For the purposes of this article, "rights-management information" shall mean any information provided by the author or his successors in title which is associated with a reproduction of a work or which is made available in connection with the communication to the public of a work, which serves to identify the work, or the author or his successors in title, or information about the terms and conditions for the use of the work, as well as any numbers or codes in which such information is represented.

Degene die opzettelijk en zonder daartoe gerechtigd te zijn elektronische informatie betreffende het beheer van rechten verwijdert of wijzigt, of werken van letterkunde, wetenschap of kunst waaruit op ongeoorloofde wijze dergelijke informatie is verwijderd of waarin op ongeoorloofde wijze dergelijke informatie is gewijzigd, verspreidt, ter verspreiding invoert, uitzendt of anderszins openbaar maakt, en weet of redelijkerwijs behoort te weten dat hij zodoende aanzet tot inbreuk op het auteursrecht, dan wel een dergelijke inbreuk mogelijk maakt, vergemakkelijkt of verbergt, handelt onrechtmatig.

Onder «informatie betreffende het beheer van rechten» wordt in dit artikel verstaan alle door de maker of zijn rechtverkrijgenden verstrekte informatie welke verbonden is met een verveelvoudiging van een werk of bij de openbaarmaking van een werk bekend wordt gemaakt, die dient ter identificatie van het werk, dan wel van de maker of zijn rechtverkrijgenden, of informatie betreffende de voorwaarden voor het gebruik van het werk, alsmede de cijfers of codes waarin die informatie is vervat.
