The representation referred to in Article 28, paragraph 2, shall consist exclusively of insured persons of the healthcare insurer or, if the healthcare insurer is part of a group as referred to in Article 24b of Book 2 of the Civil Code, of representatives of the insured persons of all healthcare insurers involved in the group.
The health insurer shall grant the rights referred to in Article 28, paragraph 2, exclusively to a representative body for which it is provided in the articles of association that, insofar as possible, it is composed in such a way that:
it, in any event with regard to age, place of residence and education, is a good reflection of the insured persons and that the composition corresponds to the diversity of the insured persons;
she can reasonably represent the various interests of the insured, and
If the representation represents insured persons of health insurers that belong to the same group as referred to in Article 24b of Book 2 of the Civil Code, there shall be a balanced distribution of the number of representatives of the insured persons of each of the health insurers concerned.
The health insurer shall determine in its articles of association the minimum number of members of which the representative body must consist, as well as the manner of appointment of those members, whereby it shall be provided that every insured person of 18 years of age or older is given the opportunity to stand as a candidate.
Representation provides for:
the regular inventorying of the wishes and opinions of the insured persons concerned; and
informing the involved insured parties about his activities and the results thereof.
The health insurer shall ensure that:
a vacancy for the representation is made public;
the representation may make use of the facilities that it reasonably requires for the performance of its duties, and
provision shall be made for the costs that are reasonably necessary for the performance of the activities of the representation, including the costs related to training, independent support, and the conducting of legal proceedings.
The health insurer shall provide the representative in a timely manner and, upon request, in writing with all information and data that she reasonably requires for the performance of her duties.
The health insurer shall, upon request, provide the representative with assistance in the implementation of the fourth paragraph.
De vertegenwoordiging, bedoeld in artikel 28, tweede lid, bestaat uitsluitend uit verzekerden van de zorgverzekeraar of, indien de zorgverzekeraar deel uitmaakt van een groep als bedoeld in artikel 24b van Boek 2 van het Burgerlijk Wetboek, uit vertegenwoordigers van de verzekerden van alle betrokken zorgverzekeraars van de groep.
De zorgverzekeraar kent de rechten, genoemd in artikel 28, tweede lid, uitsluitend toe aan een vertegenwoordiging waarvoor statutair is geregeld dat zij voor zover mogelijk zodanig is samengesteld dat:
zij wat betreft in ieder geval leeftijd, woonplaats en opleiding een goede afspiegeling is van de verzekerden en dat de samenstelling aansluit bij de verscheidenheid van de verzekerden;
zij redelijkerwijs de diverse belangen van de verzekerden kan behartigen, en
indien de vertegenwoordiging verzekerden vertegenwoordigt van zorgverzekeraars die tot eenzelfde groep als bedoeld in artikel 24b, van Boek 2 van het Burgerlijk Wetboek behoren, sprake is van een evenwichtige verdeling van het aantal vertegenwoordigers van de verzekerden van elk van de betrokken zorgverzekeraars.
De zorgverzekeraar bepaalt in zijn statuten het aantal leden waaruit de vertegenwoordiging ten minste moet bestaan alsmede de wijze van benoeming van die leden, waarbij wordt bepaald dat elke verzekerde van 18 jaar of ouder in de gelegenheid wordt gesteld zich kandidaat te stellen.
De vertegenwoordiging zorgt voor:
het regelmatig inventariseren van de wensen en meningen van de betrokken verzekerden; en
het informeren van de betrokken verzekerden over zijn werkzaamheden en de resultaten daarvan.
De zorgverzekeraar draagt er zorg voor dat:
een vacature voor de vertegenwoordiging openbaar wordt gemaakt;
de vertegenwoordiging gebruik kan maken van de voorzieningen die zij redelijkerwijs nodig heeft voor de vervulling van haar werkzaamheden, en
wordt voorzien in de kosten die redelijkerwijs noodzakelijk zijn voor de vervulling van de werkzaamheden van de vertegenwoordiging, waaronder de kosten die verband houden met scholing, onafhankelijke ondersteuning en het voeren van rechtsgedingen.
De zorgverzekeraar verstrekt de vertegenwoordiging tijdig en desgevraagd schriftelijk alle inlichtingen en gegevens die zij voor de vervulling van haar werkzaamheden redelijkerwijs nodig heeft.
De zorgverzekeraar verleent de vertegenwoordiging desgevraagd hulp bij de uitvoering van het vierde lid.
